Heard learned counsel for the parties.

At the outset, learned AGP submits that even if the Petition is allowed and the proceeding before the State Transport Appellate Tribunal is restored back to its original file, the Petitioner does not stand to gain, in view of the new Government Resolution of 2017, wherein certain new conditions have been introduced for issuance of fresh permits for Auto Rickshaws and Taxis. He submits that the Petitioner will now have to fulfill the conditions set out in the new G. R. of 2017 for issuance of fresh

WP 8236-16 permit for Auto Rickshaw and Taxi. Learned AGP on instructions submits that if an Application is filed by the Petitioner within one week and if the Petitioner submits all the requisite documents and fulfills the necessary conditions, the Transport Appellate Tribunal will take an appropriate decision on the same, within two weeks thereafter. The said statement is accepted.

In view of the aforesaid, learned counsel for the Petitioner does not press this Petition and seeks leave to withdraw the Petition. If an Application is filed by the Petitioner along with all the requisite documents within one week from today, the Transport Appellate Tribunal shall take an appropriate decision on the said Application, within two weeks thereafter. 4.

With the aforesaid directions, the Petition is disposed of as withdrawn.
