Admittedly, the trial Court has rejected the Application of Petitioner below Exhibit-17 in Sessions Case No.326 of 2020 filed under Section 227 of the Cr.P.C., for discharge, by its Order dated 2nd February 2023.

Learned Advocate for the Petitioner therefore seeks leave to withdraw the Petition with liberty to challenge the Order dated 2nd February 2023 passed below Exhibit-17 in Sessions Case No.326 of 2020 before the appropriate Bench.

Leave and liberty granted.

Petition is disposed off as withdrawn with aforesaid liberty.
