The Application preferred by Maru Yellappa Kunchikurve dated 17/04/2023, seek his release on bail by taking recourse to Section 436-A of Cr.P.C. He has made a grievance that two and half years have expired, when the charge is framed, but his case is not taken up for hearing. 2.

The learned A.P.P. makes a categorical statement that the Applicant is facing charge under MCOC Act read with Sections 387, 392, 323, 506(2), 504 read with Section 34 of IPC. According to her, trial has commenced and eight (8) witnesses have been examined till date and six (6) more witnesses are to be examined by the prosecution. M.M.Salgaonkar

The Applicant came to be arrested on 30/01/2020 and, since, now it is informed that the trial is in progress, I deem it appropriate to issue direction to the Sessions Court, Gr.Mumbai, which is seized of MCOC Special Case No. 581 of 2020, to conclude the trial on or before 31/12/2024. With the aforesaid direction, the Application stands disposed off.
