DATED : 22nd NOVEMBER, 2021 P.C:- The respondent husband, on being served, accede to the request made by the applicant in the present application. A fair statement is made by him to the effect that he has no objection for transfer of Special Marriage Petition No.1 of 2021 filed by him in the Adhoc District Judge-1, Raigad at Alibag to the Family Court at Bandra, Mumbai, as prayed by the wife. Learned counsel for the applicant inform that the Special Marriage Petition No.1 of 2021 has been transferred to the Family Court at Alibag on its transfer it is re-numbered as Petition No. 121/21 and is presently pending. The counsel for the respondent state that he has filed an interim application for temporary custody and visitation rights on his minor daughters and the said application filed on 19th April 2021 is pending for Tilak

A request came from him in presence of the respondent who is present in the Court, that on transfer of the Special Marriage Petition to the Family Court at Bandra, Mumbai, the Court shall give preference to hearing of the said application and the said application shall be decided on or before 31st December 2021.

Request made being justified one, on the proceedings of Special Marriage Petition No.121 of 2021 being transferred to the Family Court at Bandra in Mumbai, the learned Judge, is requested to decide the aforesaid application filed by the respondent on or before 31st December 2021.

Hence, the following order :-

O R D E R

Miscellaneous Civil Application is allowed in terms of prayer clause (a) which read thus :

"(a) To call for record and proceedings of Special Marriage Petition No.1 of 2021(Special Marriage Petition No.121 of 2021) from the Court of Adhoc District Judge-1 Raigad at Alibag".

The Family Court, Alibag shall forthwith transmit the record of Petition to the Family Court at Bandra, Mumbai. Application is disposed of accordingly.
