Heard learned Counsel for the applicant and learned APP for the State.

The applicant is arraigned in C.R. No.714 of 2017 registered with Juhu Police Station for the offences punishable under Sections 302, 363, 377 and 201 of the Indian Penal Code, 1860 and Sections 4 and 8 of the Protection of Children from Sexual Offences Act, 2012 ('POCSO Act').

When the Court has indicated its disinclination to entertain 1 / 2

sg 27.ba1384-23.doc the application, having regard to the nature of the accusation and the fact that a 11 year old child was allegedly done to death to gratify the lust, the learned Counsel for the applicant submitted that having regard to the period of incarceration (since 30th November, 2017), the trial be expedited.

In the backdrop of the nature of the accusation and the period of incarceration, it is imperative to commence and conclude the trial in Special Case No.103 of 2018 as expeditiously as possible. 5.

The learned Judge Special Court seized with Special Case No.103 of 2018 is requested to commence and conclude the trial in Special Case No.103 of 2018 as expeditiously as possible and preferably within a period of 9 months from the date of communication of this order.

The applicant shall co-operate for an expeditious conclusion of the trial and shall not seek any adjournment. Application disposed.
