The Applicant is seeking anticipatory bail in connection with C.R.No.5/2021 registered with Cyber Police Station, Central Division, under sections 408, 420, 506 r/w 34 of the Indian Penal Code and under sections 43B, 66C and 72 of the Information Technology Act, 2000.

At the outset, learned APP very fairly states that as per the instructions of the Investigating Officer, the Applicant has Nesarikar

2 / 3 recently delivered a baby and the investigating agency does not want to arrest the Applicant and her custodial interrogation is not strictly necessary. It would be sufficient if she attends the police station as and when called and if she cooperates with the investigation.

Learned counsel for the Applicant states that the Applicant shall attend the investigating agency' s office as and when called and shall cooperate with the investigation. 4.

In view of these submissions, Applicant can be protected by an order of anticipatory bail without going into the merits of the case since the investigating agency does not want to arrest the Applicant.

Hence, the following order :

O R D E R

(i) In the event of her arrest in connection with C.R.No.5/2021 registered with Cyber Police

3 / 3 Station, Central Division, the Applicant is directed to be released on bail on her furnishing PR bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.

(ii) The Applicant shall attend the concerned Police Station as and when called and shall cooperate with the investigation.
