rpa 2/3 44 aba 1634 2021.doc The First Information Report (for short 'F.I.R.') is about the incident dated 29/05/2021, wherein, the applicant and others had assaulted one Vishal Parimal because of his interference in their friendship with the informant's brother Akash. The allegations are that the accused Annu gave a blow with sword on the informant's knee. Chetan and Rushi tried to assault him with sword. To save himself the informant put up his left hand, causing injury to his left hand. The allegations against the present applicant are that, he gave a blow with sword on the informant's head. One other accused Pattya gave a blow on the informant's left hand. On this basis the F.I.R. is lodged. The F.I.R. mentions that the informant's left hand was fractured.

Learned counsel for the applicant submitted that the applicant is attributed role of assaulting the informant on his head. There is no serious injury on the head. He is not concerned with the injury to his hand resulting fracture. Learned counsel for the applicant submits that the interim order granted to the applicant on 23rd July, 2021, was executed. The applicant has furnished bail bonds. On completion of investigation, charge sheet is fled. This fact is confrmed by the learned APP.

:: O R D E R ::

(i) Anticipatory Bail Application No.1634 of 2021, is allowed;

(ii) Interim order dated 23rd July, 2021, is confrmed; (iii) In the event of his arrest in connection with C.R.No. 344 of 2021 registered with Mankhurd Police Station, Mumbai, till the next date, the Applicant be released on bail on his executing P.R. bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.

(iv) Anticipatory Bail Application No.1634 of 2021, stands disposed of accordingly.
