This is an application for extension of time to deposit an amount of Rs.20,00,000/- in the Registry of this Court. In pursuant to an order dated 4th May, 2018, and in view of the Affidavit filed by the applicant, the applicant was suppose to deposit a sum of Rs.20,00,000/- in the Registry of this Court on or before 11th May, 2018.

The learned Counsel for the applicant submitted that as the applicant could not arrange the funds within the said stipulated period, he drew Demand Draft for the said 1/3

amount on 21st May, 2018 and when he had been to deposit the same, it was informed that the period of deposit has already been lapsed and he has to move the Court for extension of time. In the said order dated 4th May, 2018, in para 9, it has been clearly mentioned that, in case of any single default in making the payments, the interim relief granted to the applicant shall forthwith stand vacated. The learned Counsel for the applicant further submitted that, due to extreme financial difficulty, the applicant could not arrange the funds of Rs.20,00,000/- within the stipulated period and therefore there is a delay of 10 days at his behest. He submitted that the rest of the undertakings given by the applicant and the directions mentioned in para 5 of the order dated 4th May, 2018 will be adhered scrupulously without seeking any extension for deposit of the said instalments in that behalf. The said statement is accepted.

In view of the above and for the reasons stated in the application and in the interest of justice, the delay in depositing the said amount of Rs.20,00,000/- in the Registry of this Court is hereby condoned and the applicant 2/3

is directed to deposit the said amount in the Registry of this Court within a period of ten days from today. 4.

Application is allowed in aforesaid terms.
