It is true that Regular Bail Application filed by this Applicant was heard by learned Single Judge of this Court (Smt. Justice Anuja Prabhudessai, J.) and now, the Applications are reserved for orders. A copy of that order dated 2nd May, 2023 is tendered on record and marked as Annexure-X.

It is true that the Applicant is facing some medical issue. A copy of report given by Medical Superintendent of Sir J.J. Group of Hospitals dated 25th May, 2023 is tendered on record. It shows suture hemorrhoidopexy was fixed on 20th May 2023 as there was bleeding per rectum. It says that the patient has not consented for the procedure. It also mentions that hemoglobin has gone down. The Applicant was not satisfied with that treatment and this is the explanation offered for non cooperation.

The prayer for bail on medical ground was made before the City Civil Court. There was direction by the City Civil Court to shift him to paid ward of the JJ Hospital. As there is no paid ward, today request is nmade for shifting him to the private hospital. 5.
It is difficult to consider such request at this stage as the documents suggesting that treatment is not available with Government Hospitals is not there. At this stage, learned Advocate for the Applicant seeks liberty to withdraw the Application on the basis of instructions received from the son of the Applicant. Liberty granted. Application is disposed of.

At the same time, the Superintendent of Taloja Jail is directed to give all possible treatment which can be given to him. The 2/3
Applicant is at liberty to ask for further reliefs before the Court seized of the matter.
