The learned counsel for the applicants state that in the present C.R. the applicants face the same accusations as they faced in C.R. No. 111 of 2019 which also invoked offences punishable under 420 r/w 34 of IPC and section 3, 13(1) of MOFA and section 3 of MPID Act.

He has placed on record an order dated 20/10/2022, where the learned APP had made a statement that the custodial interrogation of the applicant is not necessary. 2.

Mr. Gavand, the learned APP do not dispute the above and submit that the role attributed to the present applicants in the subject C.R is identical. He would submit that the said order dated 20/10/2022, should mutatis mutandis be made applicable to the present applicants as the custodial interrogation of the applicants is not necessary in the similar circumstances. : ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No. 220 of 2018 registered with Economic Offences Wingh, Thane (Rural), the applicants Chintan Arvind Shah and Vinit Arvind Shah shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- each with one or more sureties in the like amount.

(c) The applicants shall report to the Investigating Officer on 24/11/2022 and 25/11/2022 between 4:00 p.m to 6:00 p.m and thereafter as and when called for. (d) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.
