At the outset the learned APP submitted that in pursuance of order dated 4/3/2016 passed in Bail Application No.1125/2016, the Law and Judiciary Department has taken note of the observations made in paragraph 2 of the said order. She on instructions from Investigating Officer Rajendra Kane of Bandra Police Station, who is personally present in the Court submitted that as of today 32 witnesses have been examined in the present case and the prosecution is intending to examine at the most 10 more witnesses.

In view of the said statement, the learned counsel for the

rsk 2/2 BA-1069-1148-16.doc respective parties seeks leave to withdraw the applications with liberty to file a fresh bail application before the trial Court, if the trial pertaining to CR No.594/2013 registered with Bandra Police Station, Mumbai, under section 395, 341, 170, 171,201, 120(B) r/w.34 of IPC pending on the file of learned Addl. Sessions Judge, Mumbai does not conclude within a period one year from today.

Leave and liberty granted.

The applications are dismissed as withdrawn.
