CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO. 360 OF 2016 G. Samuel @ Anna @ Raju .....Applicant V/s.

1. Union of India

2. The State of Maharashtra .....Respondents * * * * * * Ms. Sartaj Shaikh, Advocate for the applicant. Ms. Yasmin N. Katpitia a/w. Ms. Ankita Chaturvedi, Advocate for respondent no.1, UOI.

Ms. Anamika Malhotra, APP for respondent no.2, State. CORAM :- SMT. R.P. SONDURBALDOTA, J.

DATED :- 24TH JANUARY, 2017.

P.C. :- 1).

This petition seeks expeditious trial in N.D.P.S. Special Case No. 152 of 2009 alongwith N.D.P.S. Special Case No. 84 of 2010. Ms. Katpitia, the learned Advocate appearing for respondent no.1 points out that, a similar application had been made before the Division Bench in Writ Petition No. 757

Rane * 2/2 * Cri.Appln.-360-2016 (sr.no.36) 24th January, 2017 of 2015 filed by another accused in the same sessions case and by the order dated 1st February, 2016 after considering all the aspects of the matter including the identical grievance as raised by the petitioner herein, this Court had only made a request to the learned Judge to expedite the trial in N.D.P.S. Special Case No. 152 of 2009. The present petition has been filed about a month after passing of that order. Ms. Shaikh learned Advocate appearing for the applicant, submits that even after passing of the order dated 1st February, 2016 not much progress has been made in the trial. Considering the nature of the proceedings in N.D.P.S. trial, no fixed date for disposal of the trial can be given. Since the order of 1st February, 2016 passed in Writ Petition No. 757 of 2016 already expedites the trial, no order as regards expeditious trial need be given. Hence, the application is dismissed.
