The applicant is seeking bail after having arrested on 8th April, 2021 in Crime No. 243 of 2021, registered at Kandivali Police Station, for the offence punishable under Sections 354. 354(D), 324, 323, 506 of Indian Penal Code read with 8, 12 of POCSO Act. 2.

The allegations are of sexual assault which is punishable with five years.

The applicant is already subjected to custodial investigation. Since the investigation in the matter is completed, charge-sheet is filed. There are no criminal antecedents. As such, the applicant is directed to be released on bail. The application is allowed on following terms and conditions :

O R D E R

(i) The applicant be released on bail in Crime No. 243 of 2021, registered at Kandivali Police Station, for the offence punishable under Sections 354. 354(D), 324, 323, 506 of Indian Penal Code read with 8, 12 of POCSO Act, on furnishing P.R. bond in the sum of Rs.15,000/- with one or more sureties in the like amount. (ii) The applicant shall neither influence the prosecution witnesses in any manner nor tamper with the evidence or shall not establish contact with the victim or her family members till Charge is framed.

3/3 (iii) The applicant shall remain outside jurisdiction of the place of residence of the victim.

(iv) The Applicant undertakes to furnish his latest/permanent place of residence and mobile contact number within one week from his release.
