The learned counsel for the petitioner states that now he is not pressing prayer clause (a).

The learned counsel for the respondent No.3 on instructions states that a fresh notice will be issued under section 260 of the Maharashtra Municipal Corporations Act,1949 in respect of the illegal construction subject matter of this petition and that the fresh notice will be taken to its logical conclusion as per the directions issued by this Court in the case of Sopan Maruti Thopate and

We accept the said statements. It is obvious that considering the fact that this petition is of the year 2014 and considering the fact that the offence is already registered under section 52 of the Maharashtra Regional and Town Planning Act,1966, the aforesaid action shall be initiated and completed within a maximum period of three months from today.

By accepting the aforesaid statements and with the above directions, writ petition is disposed of.
