It is contended that the settlement is arrived between the parties and both the parties have filed an application under section 13-B of Hindu Marriage Act, 1955 for divorce by mutual consent before the Family Court, Pune. Therefore, Appellant does not wish to pursue the Appeal and prayed to give a permission to unconditional withdrawal the Appeal.

Learned Counsel of both the parties present. It appears that the dispute is amicably settled between the parties and the petition for divorce by mutual consent is filed in the Family Court. In view of this and prayer of unconditional withdrawal, the Appeal is withdrawn under Rule 3(w) of the Chapter II of the Bombay High Court Appellate Side Rules, 1960. Accordingly, Appeal is disposed of as withdrawn.
