The Petitioner is challenging the show cause notice dated 3-62017 issued by the District Deputy Registrar of Co-operative Societies for superseding the Board of Directors of the Respondent No.3 APMC. In respect of the same show cause notice two Petitions being Writ Petition No.6344 of 2017 and Writ Petition No.8643 of 2017 were filed by the two sets of the remaining Directors of the Respondent No.3 APMC. The said Writ Petition came to be disposed of by order dated 28-7-2017 by a Division Bench of this Court (B.R.Gavai and Riyaz I. Chagla JJ). Whilst disposing of the said Writ Petitions, the limited protection granted was that in the event any order is passed in the proceedings commenced pursuant to the show cause notice, the same shall not be given effect to for a period of 15 days from the date of the receipt of the said order by the Petitioners therein. mmj

wp-6346-17(19) The Learned Counsel for the Petitioner in the instant Petition in view of the said order submits that the above Petition be disposed of in the light of the said order dated 28-7-2017 in view of the fact that the other members of the board have been protected to the limited extent as stated above. The Petitioner who was the Chairman of the Board of Directors would also be entitled to the same limited protection as granted by the order dated 28-7-2017 viz; that if any order which is passed adverse to the interest of the Petitioner, the same shall not be given effect for a period of 15 days of the receipt of the said order by the Petitioner. The above Petition to accordingly stand disposed of.
