By this Application, the Applicant seeks modification of the Order dated 29th March, 2019 passed by this Court (Coram : A.S.Gadkari J.) in Criminal Bail Application No.2287 of 2017. 2.
Learned counsel for the Applicant states that vide the aforesaid Order dated 29th March, 2019, the Applicant was enlarged on bail on
2/3 furnishing P.R.Bond in the sum of Rs.1,00,000/- with one or two local sureties in the like amount. He submits that the Applicant is the only bread earning member of the family and that his children are small. He further submits that despite efforts, the Applicant is unable to get either one or two local sureties for the amount of Rs.1,00,000/-. He submits that hence, the Applicant be permitted to give one or more local sureties instead of one or two local sureties.

Learned APP has no objection, if the said condition is modified.

The Applicant was enlarged on bail vide Order dated 29th March, 2019, on the Applicant's furnishing P.R.Bond in the sum of Rs.1,00,000/- with one or two local sureties in the like amount. It appears that the Applicant is unable to furnish the sureties as directed. The applicant is languishing in jail since 2017 and till date has not availed bail. Accordingly, the condition in para 5 of Clause (i) of the Order dated 29th March, 2019, stands modified. The Applicant shall, now, be enlarged on bail on his furnishing P.R.Bond in the sum of Rs.1,00,000/-
3/3 with one or more local sureties in the like amount. Rest of the conditions, in the Order dated 29th March, 2019, to remain as it is. 5.
Accordingly, the Application is disposed of on the aforesaid terms.
