By this Civil application, the Applicant/wife is seeking condonation of 78 days delay in filing the Family Court Appeal Nesarikar
2 / 2 12-CAM-256-17.odt challenging the Judgment and Decree dated 03/11/2016 passed by the Family Court at Bandra, Mumbai, in Petition No.A576/2014 dismissing the Applicant' s Petition for Dissolution of Marriage u/s 13(1)(ia) of Hindu Marriage Act, 1955. 4.
Considering the submission made by the learned Counsel for the Applicant and averments made in the Civil Application, we are satisfied that the Applicant has made out case for allowing the Civil Application. Hence following order: (a) Delay in filing the Appeal is condoned.
(b) Civil Application stands disposed of accordingly. (c) No order as to costs.
