Heard. The learned counsel for the petitioner submits that though the petitioner filed appeal No.57/2012 u/s.152 of the Maharashtra Cooperative Societies Act, 1960 before the Hon'ble Minister for Cooperation, Mumbai on 20.01.2012, same is pending for final hearing and disposal. He submits that he received instructions not to press the Writ Petition. He further submits that the respondent No.4 may be directed to decide appeal No.57/2012 as early as possible.

On the other hand, the learned AGP for the State submits that the concerned office will decide the said appeal within four months from today. Statement is accepted.

Considering the submissions made by the learned counsel for the petitioner and the statement made by the learned AGP for the respondent, following order is passed:

Writ Petition stands dismissed as withdrawn. b.

Respondent No.4 - Hon'ble Minister for Cooperation, Mantralaya, Mumbai is directed to decide the appeal No.57/2012 filed by the petitioner u/s.152 of the Maharashtra Cooperative Societies Act, 1960, within four months from today. c.

All contentions of the parties are kept open. d.

The learned AGP is directed to inform respondent No.4 about this order.
