The learned APP argued that there are criminal antecedents so far as the present applicant is concerned. She states that custodial interrogation of the applicant is warranted. It is further argued that applicant is absconding alongwith car used in the commission of crime. 2.
Perused the F.I.R, as well as case diary. It is seen from the case diary that according to prosecution case, informant Dattu Bawane is indebted to main accused Anil Jadhav. The informant was accosted on the way at Kadam Mangal Karyalaya at Ozar village and it is alleged that accused Anil Jadhav questioned him as to when the amount of hand loan will be refunded. Thereafter according to prosecution case, co-accused 1/3
Anil, Nitin Jadhav and Roshan were also present. Applicant Vinod Jadhav assaulted the informant by means of wooden logs and taumy. It is further averred that co-accused Anil Jadhav, snatched an amount of Rs.10,000/- from the pocket of informant Dattu Bawane. It is seen that co-accused Nitin Jadhav and Roshan who allegedly played similar role in the crime in question are already granted anticipatory bail, by the learned Additional Sessions Judge, Niphad. It is reported that main accused Anil Jadhav is already released on bail. The remand report dated 15.4.206 shows that recovery was to be made from main accused Anil Jadhav. 3.
It is alleged that there are criminal antecedents with the present applicant. However, as co-accused with exactly identical role are already granted anticipatory bail, no overbearing importance can be given to this aspect. In this view of the matter, the following order. Order I) The application is allowed.
II) In the event of arrest of applicant, in crime No.33 of 2016, for offence punishable under Sections 394, 504, 506 r/w 34 of the Indian Penal Code, registered with Ozar Police Station, District: Nashik, he be released on bail on his executing P.R. Bond in the sum of Rs.25,000/- and on his furnishing surety in the like amount.
III) The applicant shall not, directly or indirectly, make any 2/3
inducement, threat or promise to any persons acquainted with the facts of the case so as to dissuade them from disclosing such facts either to the Court or to any police officer. IV) The applicant shall attend the concerned police station on each Saturday and Sunday between 11.00 a.m. to 1.00 p.m., till filing of the charge sheet and shall co-operate the Investigating officer.
V) The applicant shall not tamper with the prosecution evidence in any manner.
