This Miscellaneous Application under Section 24 of the Code of Civil Procedure is filed by the Petitioner-husband seeking transfer of the proceedings of Petition No.A-266 of 2015 pending before the 4th Family Court at Bandra, Mumbai to the Family Court at Pune. 2.
Mr.Deshmukh, learned Counsel for the Respondent on instructions from his client-Respondent submits that his client has no objection for transfer of the said Petition pending before the 4th Family Court at Bandra, Mumbai to the Family Court at Pune.

In view of the above position as taken by the Respondent, the adjudication of this Miscellaneous Civil Application is not called for. By consent of the Respondent, Petition No.A-266 of 2015 pending before the 4th Family Court at Bandra, Mumbai is transferred to the Family Court at Pune.

Learned Counsel for the Petitioner on instructions submits that the allegations which are made by the Petitioner in this application, in support of the prayers as made in this application shall stand withdrawn. 5.
All contentions on the merit of the issues are expressly kept open.

Office is directed to forward intimation of this order to the Registrar, Family Court at Bandra, Mumbai so that the papers and proceedings of the petition be transferred to the Family Court at Pune within a period of four weeks from today. The parties are directed to approach the Family Court at Pune on 14th June,2016. 7.
The Miscellaneous Civil Application is accordingly disposed of in the above terms. No order as to costs.
