IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 2354 OF 2015 Anand Vasudev Tambe.

..Petitioner.

Versus

State of Maharashtra & Others.

..Respondents.

Mr. Hemant Ghadigaonkar i/b Mr. Sandesh More for the Petitioner.

Mr. J. P. Yagnik, learned APP for the State.

Coram : RANJIT MORE & K. R. SHRIRAM, JJ.

Date : January 27, 2016.

P. C. :

1.

Heard learned Counsel appearing for the Petitioner and learned APP for the State. The Petitioner is seeking a direction to the Respondent - police authorities to register an FIR on the basis of the Petitioner's complaint dated 20th May 2015 [Exhibit- C to the petition].

2.

Learned APP, on instructions, makes a statement that the Petitioner's said complaint was duly enquired into. The enquiry did not disclose the commission of cognizable offence and therefore NC case is registered. Statement is accepted. patilsr 1 / 2

3.

In the backdrop of the statements made by the learned APP, we find that the Petitioner has an alternate and efficacious remedy. He can file a private complaint before the Magistrate, if so advised. We see no reason to entertain the writ petition and the same is therefore dismissed. [K. R. SHRIRAM, J.] [RANJIT MORE, J.] patilsr 2 / 2
