Ms.Deshmukh, the learned counsel for the applicant, on instructions, seeks leave to withdraw the application and the appeal. In such circumstances, the Civil Application is dismissed as withdrawn. Consequently, the registration of the First Appeal stands refused.

The amount of Rs.25,000/- deposited before this Court, along with interest, if any, be made over to the Motor Accident Claim Tribunal at Raigad, Alibaug. The Tribunal shall pass appropriate order for the payment of the same to the Original Claimants.

Needless to mention that the appellant shall be entitled to the refund of Court fees as per rules.

Civil Application No.2521 of 2017 and 2551 of 2018 are disposed of as infractous.
