The learned Counsel appearing for the petitioner, on instructions, seeks permission to withdraw the petition with liberty to make appropriate representation to the second respondent by pointing out various factual aspects, including the events which have occurred during the pendency of the petition. The request deserves to be accepted.

Accordingly, we pass the following order :-

ORDER

(a) The Writ Petition is disposed of as withdrawn with liberty as prayed for;

(b) If a representation is made by the petitioner to the second respondent, the same shall be disposed of in accordance with law as expeditiously as possible and preferably within a period of four months from the date of making the application; (c) All contentions on merits are kept open;

(b) The Civil Application (St.) No. 34538 of 2016 does not survive and the same is disposed of.
