Ms. Mehtra, learned AGP, at the outset, tendered an order dated 2nd September, 2017, passed by the Regional Deputy Commissioner, Social Welfare, Mumbai Division, Mumbai. Under the said order, the Regional Deputy Commissioner has sanctioned the transfer of the subject flat by way of gift deed by the petitioner No.2 in favour of the petitioner Nos. 3 and 4. The said order is taken on record. 2.

Mr. Pandit, learned counsel for the petitioner, in the light of the aforesaid order, fairly stated that the grievance raised in the petition, no more survives for consideration. He, accordingly, seeks leave to withdraw the petition. Leave as prayed for, is granted. The writ petition is disposed off as withdrawn.
