This is an application for relaxation of condition No.(ii) imposed upon the applicant while releasing him on bail by an Order dated 18.4.2018 in BA No.243 of 2018.The said condition reads as under:- (ii) The applicant shall furnish PR bond in the sum of Rs.1,00,000/- with one or more local solvent sureties in the like amount, within a period of six weeks of his 1/3

The learned counsel for the applicant submitted that the applicant is ordinary resident of city of Surat State of Gujarat and despite putting in best efforts he is unable to get solvent local sureties of the amount of Rs.1,00,000/-. He submitted that the applicant has furnished documents of his relatives who are willing to stand sureties. He further submitted that his relatives are residents of the City of Surat, State of Gujarat. He submitted that therefore the said condition may be relaxed and the applicant may be permitted to furnish his relatives as sureties who are ordinary residents of State of Gujarat. 3.

In view thereof and after perusing the record I am inclined to modify the said condition.

Hence, the following order.

a) The Condition No.(ii) is hereby modified and the applicant is permitted to furnish sureties from the city of Surat, State of Gujarat the documents whereof are submitted before this Court by way of additional compilation from Page Nos.18 to 86. b) The Trial Court is hereby directed to get the said documents verified from the concerned Investigating Agency before accepting 2/3

c) As a consequence thereof the time to furnish sureties is hereby extended by eight weeks from today.

d) Application is allowed in the aforesaid terms,. (A.S. GADKARI, J.) 3/3
