For the reasons to be recorded, Second Appeal No.773 of 1997 is dismissed.

At the request of the learned counsel for the appellant, the appellant shall not be dispossessed from the suit property for a period of eight weeks from today on the condition that the appellant submits an undertaking before this Court that he will not create any third party rights in respect of the suit property during the pendency of the stay granted by this Court. Such undertaking shall be filed within two weeks from today and a copy thereof shall be served upon the respondent's advocate simultaneously.
