Apprehending arrest in connection with Crime No. I-373/2020 dated 19.10.2020 registered with Shahapur Police Station for the offences punishable under Sections 379 read with Section 34 of the Indian Penal Code

Rane 2/2 ABA-820-2020 (SR.16) Monday, 14.12.2020 and under Section 48(7) and 48(8) of the Maharashtra Land Revenue Code, the applicant is seeking pre-arrest bail.

Applicant was found extracting the sand illegally and unauthorisedly from the river bed at Shahapur. Offences of similar nature were registered against the applicant in 2016; being FIR No.33/2016 and FIR No.165/2018. In these two crimes, applicant was released on bail. Prima-facie, therefore, subject crime has been committed by the applicant while he was on bail in earlier two crimes. In consideration of the facts of the case, it is not a fit case to grant pre-arrest bail. Custodial interrogation of the applicant is required. The application is therefore rejected.
