The petitioner convict seeks benefit of State remission on account of 125th birth anniversary of Dr. Babasaheb Ambedkar. Learned APP upon instructions states that appraisal in terms of section 432 (2) of Cr.P.C. has been called for from Additional Sessions Court at Nashik in Sessions Case No.106/2015 and it is still pending. 2.

In this situation, with direction to convicting Court to expedite action and to submit suitable appraisal report within a period of 6 weeks from the date of communication of this order to it and with further directions to State Government to expedite action upon the request for remission and to take final decision within a further period of 8 weeks, we dispose of the writ petition. The order be communicated to the prisoner so also to the convicting Court.
