The learned counsel appearing on behalf of respondent No.2 tendered a copy of order dated 7 December 2017 passed in case bearing C.C. No. 4332/SS/2014 which was pending before the Metropolitan Magistrate, 14th Court, Girgaon, Mumbai, and submits that the parties had already reached a settlement and the complaint was withdrawn by complainant/respondent No.2 before the learned trial Court unconditionally. Both the accused were accordingly acquitted by the learned Metropolitan Magistrate and nothing survives in this petition. The said order is taken on record and marked as 'X' for identification.

In view of this, nothing survives in the petition and the petition stands dismissed as infructuous.
