The Petitioner is admittedly challenging the Part-I Award. In view of the Judgment of the Apex Court in the case of The Cooper Engineering Ltd. vs. P.P. Mundhe reported in AIR 1975 SC 1900, this is not a petition warranting exercise of writ jurisdiction of this Court at this stage. However, the Petitioner would be at liberty to challenge the impugned order as and when proceedings shall be finally decided and he is required to carry the matter to a higher court. All rival contentions are kept open. Hearing of Reference (IDA) No.19 of 2013 is expedited and Labour Court, Solapur shall dispose off the same within a period of twelve weeks from the date of this order. The parties and/or their Advocates shall appear before the Labour Court, Solapur on 8 th December, 2017 at 11.00 a.m. and obtain necessary directions in the matter. The above Writ Petition is accordingly disposed off with no order as to costs. ( S.J.KATHAWALLA, J. )
