By this Petition under Article 227 of the Constitution of India, the petitioner has challenged the Judgment and order dated 8.7.2014 passed by the learned 3rd Jt. Civil Judge, Senior Division, Thane, below Exhibit 5 in Regular Civil Suit No. 505 of 2013 as also the Judgment and order dated 9.6.2016 passed by the learned District Judge-7, Thane in Misc. Civil Appeal No. 115 of 2014. By these orders, the Courts below rejected the application made by the petitioner, hereinafter referred to as 'plaintiff', for injunction restraining the defendant-Corporation from implementing the notice dated 21.6.2013 issued under section 268 (1)(c) of the Maharashtra Municipal Corporations Act, (for short, 'Act').

After arguing the matter for sometime, Mr.Mishra, on instructions, seeks permission to withdraw this Petition. In view thereof, on the motion made by Mr.Mishra, Petition is allowed to be withdrawn and is dismissed as withdrawn. Order accordingly.
