1] After this matter was argued for some time, the learned counsel for the parties fairly state that this petition can be disposed of with the following agreed order:

(i) The respondent husband shall pay interim maintenance at the rate of Rs.3,000/- per month to the minor daughter Pragati with effect from 4th October, 2016. The arrears will be cleared within a period of four weeks from today;

(ii) The petitioner's application pending before the trial Court for setting aside of exparte decree dated 2nd September 2015 to be disposed of by the learned trial Judge within a period of three months from the date the respondent husband clears the arrears of maintenance payable to Pragati in terms of clause (i) above;

skc 917-WP-8154-17.doc (iii) Payment of the aforesaid amount is only an ad hoc arrangement without prejudice to the rights and contentions of the parties;

(iv) The impugned order dated 22nd March 2017 stands modified in the aforesaid terms.

(v) The consent as aforesaid, is on the basis of the instructions of the parties.

2] The petition is disposed of in the aforesaid terms. 3] All concerned to act on basis of authenticated copy of this order.
