IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CRIMINAL WRIT PETITION NO.2328 OF 2014 Shakti Singh Jaswant Singh Dudhani ...
Petitioner Vs.
State of Maharashtra ...
Respondent Through jail - None for the petitioner.
Mr. K. V. Saste, APP for Respondent-State.
CORAM : S. S. SHINDE & MILIND N. JADHAV, JJ.
DATE : JUNE 08, 2022 P.C. :
.
It appears that being aggrieved by the decision of the respondent not to allow the application of the petitioner to release him on parole, this petition is filed.
2.
Learned APP submits that since the police report was not in favour of the petitioner, prayer to release him on parole was not considered favourably.
3.
Since the grievance of the petitioner relates back to the year 2013 and under the relevant rules, petitioner is entitled to apply for parole after six months, it would be open for the petitioner to once again apply for the parole in case his grievance still subsists.
4.
With the above observations, writ petition stands disposed of. 5.
The Registry shall send a copy of this order to the concerned jail authority, who in turn shall communicate the same to the petitioner in case the petitioner is available in the said jail. (MILIND N. JADHAV, J.) (S. S. SHINDE, J.) 1/1 Minal Parab
