By an order dated 17/02/2020, trial in C.R.No.844 of 2019, which invoke Section 304 of IPC, was directed to be concluded on or before 31/05/2021. On failure to do so, the applicant was granted liberty to renew his request. 2.

Learned A.P.P. makes a statement that as on date nine witnesses have been examined and the prosecution is desirous of examining 11 more witnesses.

2/2 33 BA-1941-2.doc Learned counsel for the applicant specifcally states that when the matter was heard by this Court previously, a statement was made that the prosecution would be examining not more than ten witnesses.

Learned A.P.P. is reminded of the said statement made before the Court, though was not recorded in writing. 3.

Whatever may be the number of witnesses the prosecution intends to examine, since the trial was directed to be concluded by the month of May, 2021 and more than one year has expired, let the trial be concluded within a period of three months from today.

The Sessions Court, Thane is requested to continue with the trial in Sessions Case No.36 of 2020 on day-to-day basis and conclude the recording of evidence within a period of two months and by completing the other steps like recording of statement under Section 313 of Cr.P.C. and arguments, in any case, the trial shall be completed on or before 31/12/2022. 5.

With the aforesaid direction, the application stands disposed off.
