Apart from pendency of an Appeal under Section 70 of the Maharashtra Public Trust Act ('the Act' for short) at the behest of the petitioner before Charity Commissioner, proceedings initiated under Section 41A of the act against respondent is also informed to be pending.

In view of above, in my opinion, petition is not maintainable.

However, in case if the petitioner takes out an application for expeditious disposal of Section 41A proceedings against the respondent which are pending before the competent forum, same be decided expeditiously.
