This is an application for modification of order dated 29th January 2015.

By the said order the applicant is directed to be released on bail pending appeal with the condition that the applicant/appellant shall report to the Trial Court on every Monday till the disposal of the appeal. The learned counsel appearing for the applicant submitted that since his release from jail, the applicant is regularly attending the trial Court and N.S. Kamble page 1 of 2

79-appa-730-2016 he has complied with the said order. In view of the facts mentioned in the application I am inclined to modify the said condition.

The condition imposed upon the applicant in para no.9 of order dated 29th January 2015 is hereby relaxed and the applicant is hereby directed to attend the trial Court once in three months on first Monday between 11.00 a.m. to 2.00 p.m. of the said month during the pendency of the appeal. It is made clear that in case of any two consecutive defaults in attending the Trial Court by the applicant, the prosecution will be entitled for seeking cancellation of the bail granted by this Court.
