By the present application, the applicant seeks withdrawal of the amount deposited in this Court by respondent No.2, in furtherance of the order dated 28/03/2019.

Learned counsel for the applicant states that the amount was undertaken to be deposited by respondent No.2 to prove M.M.Salgaonkar

2/2 7 APPP-788-19.doc his bonafdes and without prejudice to his rights and contentions.

The applicant seeks withdrawal of the said amount as the total amount involved and paid by the complainant to the applicant for purchase of a fat was Rs.14,50,000/-. 3.

Learned counsel for respondent No.2, on instructions of respondent No.2-Sachin G. Pawar, who is present in the Court, states that respondent No.2 has no-objection to permit withdrawal of the said amount.

The parties have placed on record the consent terms wherein respondent No.2 has given unconditional consent for withdrawal of the amount and they have also arrived at a settlement in respect of criminal complaint bearing R.C.C.No.449 of 2021. The consent terms are taken on record and marked 'X' for identifcation.

In the wake of the above, Registry shall permit applicantDilip Panigrahi to withdraw the amount of Rs.14,50,000/- on establishing his identity.

The application stands disposed off.
