Heard the learned Advocates for the parties and the following order is passed by consent :

(i) The Applicant shall continue to attend the Court of the Civil Judge, Senior Division, Panvel and contest the Divorce Petition being No.341 of 2015 filed by the Respondent husband.

(ii)The Respondent who is present in Court undertakes to pay an amount of Rs.2,000/- to the Applicant every month towards her maintenance and the maintenance of the child. The amount of Rs.2,000/- for the month of July 2017 shall be paid on or before 18 th July, 2017 and thereafter, on or before the 10th day of each month starting from 10 th August, 2017, until further orders.

(iii)In the event of the Respondent committing any default in payment as ssp 1/2

mca 178 of 2017 (902).sxw directed above, apart from the Applicant being entitled to take out contempt proceedings against the Respondent for breach of the undertaking given to this Court, the Hindu Marriage Petition No.341 of 2015 (divorce Petition) filed by the Respondent husband before the Civil Judge, Senior division, Panvel, shall stand transferred to the Family Court at Pune without any further orders from this Court.
