Mr. Sugdare states that the issue in this petition is squarely covered by a judgment of this Court in Sahakar Maharshi Shankarrao Mohite Patil Sahakari Sakhar Karkhana Ltd. V/s. State of Maharashtra and Ors.1 Mrs. Bhide confirms the same but at the same time states that an SLP against Sahakar Maharshi Shankarrao Mohite Patil Sahakari Sakhar Karkhana Ltd. (Supra) is admitted by the Apex Court but no stay has been granted.

Therefore, in view of the law as prevailing, the petition is allowed in terms of prayer clauses - (1) and (2), excluding the interest portion in prayer clause - (2). Since in Sahakar Maharshi Shankarrao Mohite Patil Sahakari Sakhar Karkhana Ltd. (Supra), the Court has granted interest at 9% p.a., we also grant interest at 9% p.a.
