By virtue of judgment and order dated 3 May 2023 in the earlier round of litigation, this Court had directed the case of the Petitioner to be considered sympathetically by the Government for grant of extension in the period for joining at Aurangabad on account of his transfer from Pune. Pursuant to the orders so passed, it appears that the 1/2

State has considered the representation of the Petitioner and taking a sympathetic view of the matter directed the Authorities to allow the Petitioner to proceed on leave after joining at Aurangabad. Infact one of the prayers made during the course of hearing before us by the learned Counsel for the Petitioner was that if leave could be granted, he could ensure continuity in the treatment of his wife at Mumbai who is suffering from breast cancer.

After having heard learned Counsel for the Petitioner as also having gone through the order of consideration passed by the Government pursuant to the directions of this Court dated 3 May 2023, we do not find any reason to interfere with the order of consideration so passed. It would be open to the Petitioner to join at Aurangabad forthwith and apply for leave which shall be granted to the Petitioner in terms of directions issued by the Government vide communication dated 26 May 2023.

The Petition is disposed of accordingly.
