Considering the challenge raised in the above Criminal Writ Petition, the same is not maintainable. The learned Additional Public Prosecutor points out that the charge sheet has already been filed in the year 2009. The application for further investigation was filed by the Petitioner on 29/03/2014 i.e. a good five years after the charge sheet was filed. We do not deem it appropriate to dvelve further into the factual aspect since in our view the remedy if any of the Petitioner is to invoke the revisionary jurisdiction before the Sessions Court. The above Criminal Writ Petition is accordingly disposed of as not maintainable. It would be open for the Petitioner, if so advised, to invoke the revisionary jurisdiction before the Sessions Court.
