Mr.Subhash Jha i/b Law Global Advocates, for the Petitioner. Mrs.A.S.Pai, A.P.P for the Respondent-State.
CORAM : R. M. SAVANT & REVATI MOHITE DERE, JJ.
DATE : 11th JULY, 2018 P.C. :
1.
The above Writ Petition has been filed for quashing of the C.R. being No.I-181 of 2016 registered with the Narpoli Police Station, Bhiwandi, District - Thane (now transferred to Crime Branch, Unit - II, Bhiwandi, District - Thane), for the offences punishable under Sections 420, 504, 506(2) and 120B of the Indian Penal Code. 2.
The FIR is a fall out of the transaction in respect of supply of
2/2 25-wp.2390.2018.doc raw material for medicine. The First Informant is a Company which had supplied the said raw material. It is required to be noted that the above Petition has been filed by the Petitioner who is one of the accused through his mother.
3.
The learned APP informs us that right from the inception i.e. from the year 2016, the Petitioner - Kapil Gajanand Shukal is absconding. The learned counsel for the Petitioner sought to raise various contentions revolving around the registration of the FIR, in the context of the fact that the transaction in question is of supply of goods and money not paid. 4.
We refuse to entertain such contentions in the above Petition especially having regard to the fact that the Petitioner is an absconding accused. We, therefore, do not deem this a fit case to entertain the above Writ Petition.
5.
The Writ Petition is accordingly dismissed.
