This is an application under section 482 of Cr.P.C. Learned counsel for the applicant seeks leave to amend for incorporating a challenge in the chargesheet. The chargesheet is already annexed to the application.

It is not the case made out in the application that the applicant is relying upon any document which is not a part of the chargesheet. Another ground mentioned in the application is that second respondent who is the father of the victim girl does not want to proceed with the case. The victim girl is a minor and, therefore, father's consent is irrelevant. Therefore, we decline to

rsk 2 APL-655-16.doc entertain this application under section 482 of Cr.P.C. However, it will be open for the applicant to file appropriate proceedings before the appropriate Court.

All contentions of the parties on merits are kept open. The application is disposed of.
