The learned counsel for the Petitioner submits that proposal of the Petitioner for grant of insurance cover (ex-gratia) on account of death of his wife while performing Covid-19 duty is forwarded by the Deputy Director Health Service to the Director of Health Service on 21st September 2021. However, the Director of Health Services has not taken any decision as yet.

The learned Advocate appears on behalf of Respondent No.1-Union of India and the learned AGP appears on behalf of Respondent Nos.2 to 5. It is submitted that the Director of Health Services has to consider the said recommendation/proposal and thereafter forward it to the Insurance Company.

The Director of Health Service shall consider the recommendation forwarded by Respondent No.4 to it (page 51) and shall thereafter with his noting refer it to Respondent No.6 expeditiously and preferably within two months. Thereafter, the decision may be taken by the Respondent No.6 accordingly.

The Writ Petition is disposed of. No costs.
