Learned advocate for applicant submits that in accordance with order dated 30th July 2021, Rs.40 lakh has been deposited with Investigating Officer. It is further submitted that two installments of Rs.50 lakh and Rs.55 lakh each will be deposited within the stipulated time. It is difficult to arrange cash and deposit the amount with Investigating Officer. It is submitted that charge sheet has been filed against one of the arrested co-accused before the Court of Metropolitan Magistrate, 65th Court, Andheri in case No.907/PW/2021. The applicant shall deposit balance amount of Rs.50 lakh and Rs.55 lakh as per schedule given by the applicant before Trial Court in the aforesaid proceedings. Accordingly, the applicant is permitted to deposit Rs.50 lakh on or before 20th September 2021 and Rs.55 lakh on or before 15th November 2021 before Trial Court in case No.907/PW/2021.

In view of the aforesaid circumstances, the application can be disposed of. Hence, I pass following order :

ORDER

(i) Anticipatory Bail Application is allowed and disposed of; (ii) In the event of arrest of applicant in CR No.60 of 2021 registered with Vile Parle Police Station, the applicant be released on bail on executing PR bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

(iii) The applicant shall comply undertaking of depositing amount of Rs.50 lakh and Rs.55 lakh respectively as per schedule; (iv) In the event of breach in depositing the amount, the prosecution will be at liberty to prefer application for cancellation of anticipatory bail granted to applicant.
