Mrs. Kantharia, learned APP, having taken instructions from the officer concerned, makes a statement that the investigation into the said CR having been completed, charge-sheet is already filed in the year 2010.

In the light of the aforesaid statement, learned counsel for the petitioner seeks leave to withdraw the aforesaid petition with liberty to file a discharge application if charge is not already framed.
