Learned counsel for appellant submits that he received instructions from his client that the First Appeal as well as Civil Application to be withdrawn. To that effect, he has given writing. Same is taken on record and marked 'X' for identification. Same is accepted.

Learned counsel for appellant submits that at the time of filing of present First Appeal, they deposited an amount of Rs.25,000/- in the Registry of this Court. He submits that the Registry may be directed to refund the said amount to the Insurance Company alongwith the accrued interest if Chitra Sonawane.

Hence, the following order.
a) First Appeal as well as Civil application disposed of as withdrawn.
b) Appellant/Insurance Company is permitted to withdraw statutory deposit of Rs.25,000/- deposited at the time of filing of the First Appeal, with accrued interest if any, without furnishing any security.
c) Refund of the Court fees according to law.
d) No order as to costs.
e) Interim relief if any, granted earlier is vacated.
