This Application is filed for condonation of delay caused in depositing cost of Rs.10,000/- pursuant to order dated 16.01.2017 passed by this Court. By order dated 16.01.2017 in Civil Application No.5064 of 2011, this Court had directed to pay cost of Rs.10,000/- towards condition for restoration of Civil Application No.2018 of 2011 for bringing on record legal heirs of deceased Respondent No.2. In the said order, it was also mentioned that the Application sought to restore Civil Application No.4754 of 2006 for condonation of delay of 119 days in instituting the First Appeal. However, no steps were taken as directed by the Court in the said BGP.

order. In the main Appeal i.e. First Appeal Stamp No.30660 of 2002, it is seen that it is filed challenging the enhancement of amount of compensation of Rs.51,469/-.

On going through the Application, this Court finds that no case is made out to cause indulgence in this matter. No purpose would be served even if the Application is allowed. 3.

The Application is therefore dismissed.
