This is an application under section 438 of the Code of Criminal Procedure, 1973. The applicant herein is apprehending his arrest in Crime No. 284 of 2016 registered at Kashimira Police Station on 20/4/2016 for offence punishable under section 420 read with section 34 of the Indian Penal Code. The applicant herein was protected by this Court vide order dated 17/6/2016 only on the Talwalkar 1/2

914.aba1008.16.sxw ground that the applicant was protected by the trial Court earlier. Interim relief was not granted after considering merits of the matter. After arguing at length, learned Counsel for the applicant seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice.

The applicant shall surrender before the concerned Magistrate on or before 29th March, 2017. The learned Magistrate shall consider the application on its own merits without being influenced by the withdrawal of this application. The application stands protected till 5 p.m. of 29th March, 2017.

The application stands dismissed as withdrawn and disposed of accordingly.
